Welcome to The Gizmo Grotto. These Terms of Service ("Terms") govern your use of thegizmogrotto.com (the "Site") and any purchase you make from us. By using the Site or placing an order, you agree to these Terms. Our Shipping & Local Pickup Policy, Returns & Refunds Policy and Privacy Policy are part of these Terms.

1. Use of the Site

You may use the Site only for lawful purposes. You agree not to:

• violate any law or regulation;
• infringe the rights of others, including intellectual-property rights;
• upload or transmit viruses, malware or other harmful content;
• interfere with the normal operation or security of the Site; or
• use the Site for unauthorized commercial purposes, including scraping.

2. Accounts

You're responsible for keeping your login credentials confidential and for all activity under your account. Tell us right away if you suspect unauthorized access. We may suspend or close accounts that violate these Terms.

3. Products, pricing and availability

• Most of our products are made to order, often 3D printed. Photos are representative; minor variations in color, finish and layer texture are normal and aren't defects.
• All prices are in U.S. dollars. Sales tax is calculated at checkout where required. Shipping is charged as described in our Shipping Policy.
• We may correct pricing or description errors and may refuse or cancel any order, including after payment (for example, a pricing error, suspected fraud, or an item we can't produce). If we cancel a paid order, we'll refund you in full.

4. Orders and payment

• Payment is processed securely by Stripe using the methods offered at checkout.
• Deposit orders: some items and custom projects may be ordered with a 50% deposit. The remaining balance must be paid before the order ships or is released for pickup. Deposit refund rules are in our Returns & Refunds Policy.
• We ship to the address you provide at checkout. Please make sure it's correct.

5. Custom work and your content

• When you submit a custom request (designs, photos, logos, text or files), you confirm that you own or have permission to use that content, and you grant us a limited license to use it to quote, design and produce your order.
• We may refuse requests that infringe someone else's rights or that we consider unsafe, illegal or offensive.
• We may photograph finished custom work for our portfolio or social media unless you ask us not to when you order. We won't show your personal information.
• Unless we agree otherwise in writing, design files we create remain our property. You own the physical item you buy.

6. Product use

Many of our items are made of PLA or similar plastics. They're not heat-resistant, flame-resistant or food-safe unless the product page says so, and some contain small parts that aren't suitable for young children. Use items as intended and follow any care or safety notes on the product page.

7. Intellectual property

Site content (text, graphics, logos, photos, designs and software) belongs to The Gizmo Grotto or its licensors and is protected by law. You may not copy, modify, distribute or commercially use it without our written permission.

8. Disclaimers

Except as stated in our Returns & Refunds Policy, the Site and products are provided "as is" to the fullest extent allowed by law.

9. Limitation of liability

To the fullest extent allowed by law, The Gizmo Grotto isn't liable for indirect, incidental, special, consequential or punitive damages arising from your use of the Site or our products. Our total liability for any claim relating to an order won't exceed the amount you paid for that order.

10. Governing law

These Terms are governed by the laws of the State of Texas. If you have a concern, please contact us first so we can try to resolve it informally. Any dispute that can't be resolved informally will be handled in the state or federal courts located in El Paso County, Texas, and either party may bring an individual claim in small-claims court.

11. Changes

We may update these Terms. Changes are posted here with a new "Last updated" date and apply to orders placed after that date.
